SIGNIFICANT CONTROLLERS REGISTER

Under the Companies (Amendment) Ordinance 2018, companies incorporated in Hong Kong are required to maintain a Significant Controllers Register ( “SCR”) that contains particulars of significant controllers (“SCs”) — registrable persons and/or registrable legal entities with significant control over the company.

Each company must also designated at least one person as its representative to provide assistance relating to the significant controllers register of the company to law enforcement officers.

The Amendment Ordinance have came into operation on 1st March 2018.

  Significant Controllers Register: HK$500

√  Take reasonable steps to identify the company’s SCs and obtain beneficial ownership information
√ Prepare the Significant Controllers Register and enter the required particulars of the significant controller(s) and contact details of the designated representative of the company in the SCR
√ Notify the Companies Registry about where the Significant Controllers Register is stored (if the SCR is not stored in the Registered Address of the company)

  Designated Representative: HK$1,000 per year

√ Acting as the designated representative
√ Provide assistance relating to the significant controllers register of the company to law enforcement officers
√ Keep and maintain up-to-date information of SCs in a statutory register
√ Provide a place to keep the Significant Controllers Register
